  • Are the rules for public comment written, adopted, and publicly available? *
  • Do rules limit comment to matters within the body's subject-matter jurisdiction where a limited forum is intended? *

Content & Viewpoint Neutrality

  • Are restrictions content-neutral and applied without regard to the speaker's viewpoint? *
  • Is the chair restrained from silencing speakers merely for criticism of officials? *
  • Are 'disruption' removals based on actual disturbance, not offensive content? *

Time, Place & Manner

  • Are time limits per speaker reasonable and applied evenhandedly? *
  • Is a sign-up or recognition process administered neutrally? *
  • Are reasonable accommodations available for speakers with disabilities or limited English proficiency? *

Documentation

  • Are comment periods noticed on the agenda consistent with open meetings law? *
  • Is the record/minutes reflecting who spoke maintained? *
  • Are staff/officials trained on lawful management of public comment? *
