Legal Basis & Assessment

  • Does the agency recognize that failing to provide meaningful access to LEP persons may constitute national origin discrimination? *
  • Has the agency conducted the four-factor analysis to determine the extent of its language obligations? *
  • Has the agency identified the languages frequently encountered in its service area? *
  • Is a written language access plan adopted and periodically updated? *

Oral Interpretation

  • Are competent interpretation services available at no cost to the LEP individual? *
  • Are interpreters assessed for competency and confidentiality rather than relying on minor children? *
  • Is telephonic or video remote interpretation available for less common languages? *
  • Are bilingual staff who provide services assessed for language proficiency? *

Written Translation

  • Have vital documents been identified and translated into frequently encountered languages? *
  • Does the safe harbor translation threshold (5 percent or 1,000 persons) inform which languages are translated? *
  • Are translations reviewed for accuracy and plain language? *
  • Are 'I speak' language identification cards or equivalents available? *

Notice, Training & Monitoring
