Legal Authority & Industrial User Inventory

  • Has the POTW adopted a sewer-use ordinance providing pretreatment legal authority? *
  • Is an updated inventory of industrial users maintained, with SIUs and CIUs identified? *
  • Are new/changed industrial users evaluated for permitting before discharge? *

Permits & Limits

  • Do significant industrial users hold current individual control mechanisms (permits)? *
  • Are applicable federal categorical standards incorporated into permits? *
  • Have technically based local limits been developed and are they enforced? *
  • Are prohibited discharges (fire/explosion, corrosive, obstruction, slug loads) addressed? *

Monitoring & Inspections

  • Do SIUs submit periodic self-monitoring reports on the required frequency? *
  • Does the POTW independently sample and inspect each SIU at least annually? *
  • Are sampling and analysis performed using approved 40 CFR Part 136 methods? *

Enforcement Response

  • Is an Enforcement Response Plan (ERP) adopted and followed? *
  • Are significant noncompliance (SNC) industrial users identified and published annually? *
  • Are escalating enforcement actions documented and timely? *

Reporting & Records

  • Is the annual pretreatment performance report submitted to the approval authority? *
  • Are program records retained for at least three years (longer if litigation/enforcement)? *
