Wage Determination & Contract Clauses

  • Is the applicable Davis-Bacon wage determination incorporated into the contract and solicitation? *
  • Are the required Davis-Bacon and related contract clauses included in the contract? *
  • Does the applicable coverage threshold ($2,000 for construction) apply to this contract? *
  • Are proper classifications and any additional classifications (conformances) approved via SF-1444? *

Certified Payroll

  • Are weekly certified payrolls submitted by the contractor and all subcontractors? *
  • Does each payroll include the signed Statement of Compliance (WH-347 or equivalent)? *
  • Are payrolls reviewed for correct classification, hourly rate, and fringe benefits? *
  • Are payroll records retained for at least three years after project completion? *

Wage & Fringe Benefit Payment

  • Are laborers and mechanics paid not less than the prevailing wage plus fringe benefits? *
  • Are wages paid weekly and without unauthorized deductions or kickbacks? *
  • Is overtime paid per the Contract Work Hours and Safety Standards Act where applicable? *

Apprentices & Trainees

  • Are apprentices employed only if registered in an approved apprenticeship program? *
  • Is the apprentice-to-journeyworker ratio on site within the approved program limits? *
  • Are workers not registered as apprentices paid the full journeyworker prevailing rate for their classification? *

Posting, Interviews & Enforcement

  • Are the wage determination and Davis-Bacon poster (WH-1321) posted at the job site? *
  • Are on-site employee interviews conducted to verify classification and pay? *
  • Are restitution and enforcement actions documented for any underpayments found? *
